News that Kincardine residents are unlikely to secure compensation following the creation of the SAK railway line through the village has been criticised by the local MP.
In a letter to Willie Rennie MP, Transport Scotland says that residents are unlikely to receive compensation because the line was already classed as a railway by Network Rail.
The MP is also angry that the authorities are refusing to accept any responsibility for the broken promise about the operation of night trains.
"A clear promise was given that there would no night trains running through Kincardine," said Mr Rennie. "That promise has been broken.
"I had asked Stewart Stevenson, the Transport Minister, to award compensation to local residents for the promise that was broken. In reply Transport Scotland has refused to award compensation based on that simple principle.
"What makes matters worse is that compensation is unlikely on any basis now as it turns out that the line through Kincardine had never been declassified as a railway.
"The prospect of compensation has been falsely offered to residents as an attempt to keep them quiet. But because of a technicality it's unlikely that compensation will be awarded to anyone.
"I have written again to the Minister to ask him to prepare a new compensation package to all residents who live adjacent to the line. It would be the decent way to proceed."
